Before they can be lawfully sold throughout the country, including in Minnesota, e-cigarettes, electronic nicotine delivery systems (ENDS), or oral nicotine pouch products must first receive authorization from the FDA. To date, no flavored e-cigarettes or ENDS products, nor any oral nicotine pouch products have been authorized by the FDA to be lawfully sold.
Minnesota law further prohibits the sale of vaping products that are described or depicted in a manner that imitates food, such as candy, fruit, desserts, or beverages that are commonly marketed to minors. This law also prohibits the sale of vaping products that imitate school supplies, like highlighters or pens, or depict characters that are appealing to minors, including celebrities, characters in comic books, video games, or movies, and mythical creatures.
Use this form to report the marketing or sale of illegal flavored e-cigarettes, electronic nicotine delivery systems (ENDS), or oral nicotine pouch products to Minnesota consumers. The Minnesota Attorney General’s Office cannot respond to all reports it receives but will use reports to identify and respond to potential violations of Minnesota law.
